There are 2 trademark protection routes in the United States (US):
1. National registration for the United States, to be filed directly in the U.S.
You can submit a National Trademark Registration immediately. The procedure takes place entirely in the United States and is from the first moment under the supervision of our local representation, with whom we have a partnership. You are assured of very expert guidance to register your trademark in the US.
2. An International Registration with, among others, the United States as one of the chosen countries.
For an International Registration (with e.g. the United States) one must have a basic registration. For Benelux companies, this basis is a Benelux trademark registration or a European Union trademark registration. After this has been applied for, you can (after some time) apply for international trademark registration in which you also involve the United States. The procedure still takes place in Europe and is forwarded to the USA after approval of the administrative conditions by the central administration in Switzerland. Only from this moment on does an application undergo the same route as a National Trademark Registration via this procedure. So, in a sense, there is a detour.
In the United States, one almost always has to deal with objections from the official examiners. This may concern (1) the distinctive character of the trademark itself, (2) the classification submitted with the trademark application or (3) cited earlier trademarks that are too similar to the newly applied trademark.
